USER AGREEMENT

1.General provisions

1.1.Service mmcflash.eu (hereinafter - "MMCFlash") offers Internet users (hereinafter - "User") the opportunity to use the services on the terms and conditions of this User Agreement (hereinafter - "Agreement"). This Agreement comes into force from the moment the User agrees to its terms and conditions in accordance with clause 1.4. of this Agreement.

1.2.MMCFlash offers Users access to services including downloading, analyzing and modifying files. All currently available services, as well as the addition of new services, are subject to this Agreement.

1.3.Use of MMCFlash's services is subject to this Agreement and Privacy Policy and the terms of use for certain services. MMCFlash may amend this Agreement without prior notice, and the revised version of this Agreement shall be effective upon posting on the Internet at the web address specified in this paragraph, unless otherwise specified in the revised version of this Agreement. The current version of this User Agreement is always available at mmcflash.eu/agreement.

1.4.By starting to use any services/defined functions or going through the registration procedure, the User shall be deemed to have accepted the terms of this Agreement in full without any limitations or exceptions. If the User does not agree with any provisions of this Agreement, the User shall not use MMCFlash services.

2.User Registration. User account.

2.1.To use MMCFlash services or certain features, the User must register to create a unique account.

2.2.When registering, the User must provide valid and complete information requested in the registration form and regularly update such information. If the User provides incorrect information or MMCFlash has reason to believe that any information provided by the User is incomplete or invalid, MMCFlash may, in its sole discretion, block or delete the User's account or refuse to allow the User to use any services (or certain features).

2.3.MMCFlash reserves the right at any time to require the User to verify the information provided during registration.

2.4.Any personal information of the user contained in the user account will be stored and processed by MMCFlash in accordance with the Privacy Policy mmcflash.eu/policy.

3.Means of access to the User's account.

3.1.When registering, the User must provide a valid e-mail address (which is used as a login) and a password to access the account. MMCFlash may prohibit the use of certain logins and impose other requirements on the login and password (length, allowable characters, etc.).

3.2.User is responsible for the security of the selected means of accessing his/her account and for the confidentiality of such means. The User is responsible for any actions (and their consequences) in using and with the MMCFlash features through the User account, including the User's voluntary transfer of information necessary to access the User account to third parties under any terms (including contracts or agreements). Any actions in or with MMCFlash services performed through User's account shall be deemed to have been performed by User, unless User notifies MMCFlash in accordance with Section 3.3 of this Agreement of unauthorized access to MMCFlash services through User's account and/or any other breach (alleged breach) of the confidentiality of the selected means of access to its account.

3.3.The User shall immediately inform MMCFlash of any unauthorized (not authorized by the User) access to MMCFlash services through the User account and/or any breach (suspected breach) of the confidentiality of the selected means of access to his/her account. For security reasons, User must securely log out after each session of the MMCFlash Services. MMCFlash shall not be liable for any potential loss or corruption of information or any other consequences resulting from User's failure to comply with this part of this Agreement.

4.Use of the account by the User.

4.1.User may not reproduce, duplicate or copy, sell, resell or exploit for any commercial purpose any part of the MMCFlash services (including content available to User through the services) or access to the MMCFlash services, except as authorized by MMCFlash or expressly stated in the user agreement for any service.

4.2.Certain categories of user accounts may restrict or disable the use of certain MMCFlash services or some of their options if required by the registration or user terms and conditions governing such services.

5.Termination of the account.

5.1.MMCFlash may block or delete a user's account or deny access through any account to certain MMCFlash services and remove any content without explanation, including if the user violates the terms of this Agreement and the terms of any documents listed in paragraph 1.3. if the user refuses to use the service.

6.Deleting a user account.

6.1.The User may at any time delete his/her account on all MMCFlash services, if such option is available, close the account in respect of certain services. To delete an account the User should send a request to the support service: help@mmcflash.eu.

7.General provisions on use and storage

7.2.MMCFlash can send informational messages to its users.

8. User-generated content

8.1.The User is responsible for the compliance of any content posted by the User with applicable legal requirements, including liability to third parties in the event that the User's posting of any content or its subject matter violates the rights and legitimate interests of third parties, including the personal non-property rights of authors, any other intellectual property rights of third parties and/or infringement of other intangible assets.

8.2.User acknowledges and agrees that MMCFlash may use User Content at its discretion and may reproduce User Content in accordance with the technical requirements of the particular service.

9.MMCFlash Service Terms of Use.

9.1.The User is responsible to third parties for any actions related to the use of MMCFlash service, including any actions resulting in violation of the rights and legitimate interests of third parties, as well as compliance with laws when using MMCFlash service.

9.2.Violate the rights of third parties, including minors, and/or cause harm in any way;

9.3.Impersonate another person or representative of an organization and/or community without permission;

9.4.Facilitate any action to violate any restrictions and prohibitions imposed by this Agreement;

9.5.Otherwise violate legal standards, including international law.

10.Rights to services and content.

10.1.Any objects available through the MMCFlash Services, including design elements, ECU files, text, graphics, illustrations, videos, software, databases and other objects (hereinafter referred to as "Service Content"), and any content posted on the MMCFlash Services, are the property of MMCFlash, users and other copyright holders.

11.Lack of guarantees, limitation of liability.

11.1.The User uses MMCFlash services assuming all risks. MMCFlash is not responsible, including for the suitability of the services for the User's purposes.

11.2 MMCFlash does not guarantee that the services meet/will meet the User's requirements; that the services will be uninterrupted, fast, stable and error-free; that the results obtained using the services are accurate and reliable and can be used for any purpose and in any capacity (e.g. for identification and/or verification of any facts); that the quality of any product, service, information, etc. obtained using the services will meet the User's expectations.

11.3.Any information and/or materials (including ECU files, downloadable software, messages, any instructions and manuals, etc.) that the User accesses through MMCFlash services may be used by the User at the User's own risk, and the User is responsible for any potential consequences of the use of such information and/or materials, including any damage to the User's or third parties' computer, any damage to the User's or third parties' vehicle, or any other damage.

11.4.MMCFlash is not liable for any damages resulting from the User's use of MMCFlash services or individual parts/functions of the services.

11.5.If the User has any complaints about the quality of MMCFlash services, the User should contact the support team by e-mail: help@mmcflash.eu.

12.Other provisions

12.1.This Agreement is the agreement between the User and MMCFlash regarding the use of the Services and supersedes all previous agreements between the User and MMCFlash.

12.2.Nothing in this Agreement shall be construed as an agency, partnership, mutual, employment or any other relationship not expressly set forth in this Agreement.

12.3.If for any reason one or more of the provisions of this Agreement is held invalid or unenforceable, the validity or enforceability of the remaining provisions of this Agreement shall not be affected.

12.4 MMCFlash's failure to act in the event of a breach of this Agreement by the User or any other users shall not preclude MMCFlash from taking action to protect its interests in the future and shall not be construed as a waiver of MMCFlash's rights in the event of any similar or identical breaches in the future.

13.Return Policy.

13.1.The maximum period during which the User can make claims about the quality of file processing is 30 days. The beginning of this period is considered to be the time of payment for the order. This period is counted separately for each Processing Task and is not transferred to another Processing Task.

13.2.To send a claim, the User must send an e-mail to: help@mmcflash.ru from the e-mail address that the User uses in his/her account. The User acknowledges and agrees that claims will not be accepted unless they have been sent to the specified email help@mmcflash.ru from the email address the User uses in his/her account.

13.3.The User must provide detailed information in the claim about problems with the Processing Task, including a description of the problem, photos, screen shots and any other information confirming the problem. Upon MMCFlash's request, the User must provide any additional information about the problem.

13.4.User acknowledges and agrees that MMCFlash has the priority right that will fix problems with the Processing Job specified by User. User must wait for MMCFlash to correct the problem or notify User that the problem cannot be corrected.

13.5.Refunds are only possible if all of the following conditions are met:

13.5.1.if the conditions of cl. 13.1. of these Rules;

13.5.2.if the conditions of cl. 13.2. of these Rules;

13.5.3.if the conditions of cl. 13.3. of these Rules;

13.5.4.If MMCFlash has confirmed the problem and notified that user by email;

13.5.5.subject to the conditions of cl. 13.4. of these Rules.
